Mizuno Malaysia is committed to safeguarding the privacy of visitors to our Site and users of the other services available through our Site (the “Service(s)”). We will use our best efforts to ensure that the information you provide remains private and is used only for the purposes set forth herein.

The purpose of the Mizuno Malaysia Privacy Policy is to inform you as to how we manage, collect, and disclose information relating to you and the limited manner in which we will use that information to provide and improve our provision of the Services. In Malaysia, such business activities are subject to the Personal Data Protection Act 2010 (the “Malaysia PDPA”). We conduct our business in compliance with the Malaysia PDPA and ensure that any information relating to you remains safe and secure.

Definitions

“Personal Data” refers to any information in respect of commercial transactions that relates directly or indirectly to an individual, who is identified or identifiable from that information, and may include your name, street address, email address, billing address, credit card number and expiry date.

“User Information” means all Personal Data and any other forms of information discussed in this Privacy Policy, including the Internet Protocol (IP) address of a user’s computer.

“Aggregate” refers to the combination of information from various persons or users.

“Anonymized” means information which does not identify individual persons or entities or associate a particular person or entity with such information.

 

Accuracy of Information and Third Party Consent

Please ensure that all Personal Data submitted to us is complete, accurate, true, and correct. Failure on your part to do so may result in our inability to provide you with the products and services that you have requested.

Upon receipt of your request, we will cease to process your Personal Data within a reasonable time, subject to any legal or contractual restrictions.

Purpose Limitation and Notification

We collect Personal Data only for specified purposes, including order processing, account management, customer support, and marketing (where consent is given). Users are informed of the specific purpose at the point where data is collected. We will not process your Personal Data for any purpose that is unlawful or unrelated to our functions and activities.

Information We Collect and How We Use It

If you visit our Site to browse, we will only collect and store the domain name and host from which a user accessed the Internet, the IP address of the user’s computer, the user’s browser software and operating system, the date and time the user accesses the Site and the Internet address of any Web site from which the user linked directly to our Site or to which the user links after visiting our Site.

We use this information to measure the number of visitors to sections of our sites, to determine from where our visitors linked and to where our visitors link from the sites and to help us make our sites more useful. Mizuno Malaysia is the sole owner of the information collected on this Site. We will not sell, share or rent this information to others in ways different from that disclosed in this Privacy Policy.

If you complete your registration at our Site, you can communicate and deal with Mizuno Malaysia through our Site. If you communicate with us, we collect and store the Personal Data you provide through this process.

If Personal Data is removed, you may lose access to parts of the Site that require such data. After removal, we will retain only what is necessary to comply with legal obligations, resolve disputes, troubleshoot issues, or enforce agreements. Please note that information provided as part of a transaction represents a permanent record and cannot be altered once the transaction is complete.

Retention of Personal Data

We retain Personal Data only as long as necessary for business or legal purposes. For instance:

●      Account-related data is retained for up to 3 years after account closure.

●      Transactional data is retained for up to 7 years for regulatory compliance.

When no longer needed, Personal Data will be securely disposed of or anonymised in accordance with the requirements of the Malaysia PDPA.

Third Parties

The Mizuno Malaysia Privacy Policy only addresses the use and disclosure of User Information collected by Mizuno Malaysia. Such information may contain errors, intentional or otherwise, or may be offensive, inappropriate or inaccurate, and in some cases will be mislabelled or deceptively labelled.

This Site takes every precaution to protect our users’ information. Mizuno Malaysia has implemented technology and security features and strict policy guidelines to safeguard the privacy of your Personal Data from unauthorised access or improper use, and we will continue to enhance our security procedures as new technology becomes available.

Data Breach Notification

In the event of a data breach involving Personal Data, Mizuno Malaysia will take reasonable steps to mitigate the impact and safeguard your Personal Data. Where appropriate, we may notify affected individuals and the Department of Personal Data Protection (JPDP) in Malaysia.

Responses to Communications

We send responses to all communications from users. Established members will occasionally receive information on products, services or special deals. Out of respect for the privacy of our users, we present the option to not receive these types of communications. Please see our choice and opt-out below.

Site and Service Updates

We also send the user Site and service announcement updates. We communicate with the user to provide requested services via email.

Correction/Updating Personal Data

If you wish to access your Personal Data, inquire about the way in which your Personal Data has been used or disclosed by us in the past year, or wish to withdraw your consent to our use of your Personal Data, you may contact our Data Protection Officer and we will seek to attend to your request as best as we reasonably can. Please note that:

(b) In order for us to provide any Personal Data, we will need to verify your identity and may request further information about your request. You should be aware that we may take a reasonable time to process your application for access as we may need to retrieve information from storage and review the information in order to determine what information may be provided. Kindly note that we may charge you a reasonable administrative fee for retrieving your Personal Data.

Choice/Opt-out

Users may opt out of marketing communications by replying “unsubscribe” in our emails. Mizuno Malaysia does not send unsolicited marketing messages without your consent, in compliance with the Malaysia PDPA.

Children

Mizuno Malaysia recognises that minors may not be able to make informed choices about Personal Data requested online. Accordingly, Mizuno Malaysia does not target children under the age of 18 for collection of information online. Where the Personal Data of a minor is provided, we require that consent is given by the parent or legal guardian.

Merger, Assets, Sales, etc.

If Mizuno Malaysia or any of its lines of business is sold, pledged or disposed of as a going concern whether by merger, sale of assets, bankruptcy or otherwise, then the user database of Mizuno Malaysia could be sold as part of that transaction and all User Information accessed by such successor or purchaser.
